1. Who we are

This website is operated by Derek Francois, a licensed real estate agent with Logan Realty Inc, serving Palm Beach County, Florida. "Derek Sells Dirt" is the brand name used for the website. Throughout this policy, "we," "us," and "the site" refer to that business.

2. Information we collect

Information you give us

When you fill out a form on the site (for example the contact, schedule-a-consult, home-valuation, buyer-help, area-inquiry, vendor, or property-inquiry forms), we collect the information you choose to enter. Depending on the form, that can include:

• Your name
• Your email address
• Your phone number (optional on most forms)
• A property address, if you enter one
• What you are interested in (buying, selling, land, neighborhood guidance, or a general question)
• Any message or details you write
• The page you submitted the form from (for example /contact or /schedule)

Information collected automatically

If you use the search bar on the homepage, the words you type are sent to a classification service to route you to the most relevant page (see Service providers). Standard web-server and hosting logs may temporarily record technical request data. We do not store your IP address in our leads database, and the site does not run advertising or analytics trackers (see our Cookie Notice).

What we do NOT collect

The site does not ask for or store Social Security numbers, government IDs, financial-account or payment-card numbers, or precise device geolocation. Please do not send sensitive information of that kind through the website forms.

3. How we use your information

• To respond to your inquiry and provide the real estate help you asked for
• To contact you by phone, text, or email about your request (see Communications and the SMS Terms)
• To keep an internal record of leads and follow-ups so nothing is missed
• To understand, in aggregate, what visitors ask about so we can improve the site's content
• To operate, secure, and maintain the website
• To comply with legal, tax, and real estate recordkeeping obligations

We do not use your information to make automated decisions that produce legal or similarly significant effects about you.

4. How your information is shared

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We use a small set of trusted service providers to run the site. They receive only what they need to perform their function and are not permitted to use your data for their own purposes:

We may also disclose information if required by law, to enforce our Terms, to protect the rights or safety of any person, or in connection with a business transfer. We may share information with the brokerage (Logan Realty Inc) and its supervising broker as required for real estate compliance and oversight.

5. Cookies and tracking

The site uses only strictly-necessary and functional cookies (for example, to keep an administrator signed in). It does not currently use advertising, analytics, or cross-site tracking cookies. Full detail is in our Cookie Notice. If tracking technologies are added later, this policy and the Cookie Notice will be updated and any legally required consent will be requested.

6. How long we keep it

We keep lead and inquiry information for as long as needed to help you and to meet real estate, tax, and legal recordkeeping requirements, after which it is deleted or de-identified within a commercially reasonable period. Backups and third-party systems may retain copies for a limited additional time before they cycle out.

7. How we protect it

Information you submit is transmitted over encrypted (HTTPS/TLS) connections. Lead data is stored in our database provider (Supabase), which encrypts data at rest. The public website can only submit a lead and can never read one back. Administrative access requires a server-verified password, creates a signed, HTTP-only, expiring session cookie, and uses server-only credentials for privileged database operations. Login attempts are rate-limited. No method of transmission or storage is completely secure, so we cannot guarantee absolute security, but we work to protect your information using reasonable safeguards.

8. Your choices and rights

You can ask us to access, correct, or delete the personal information we hold about you, and you can opt out of marketing communications at any time. To make a request, contact us using the details at the end of this policy. We will verify your request and respond within the time required by applicable law. We will not discriminate against you for exercising these rights.

9. State privacy rights

Depending on where you live and on whether a given law applies to this business, you may have additional rights under your state's privacy law (for example, in Florida, California, Colorado, Virginia, Connecticut, or Texas), such as the right to know, delete, correct, and opt out of certain processing. We honor the core access, correction, deletion, and opt-out choices described above for all visitors regardless of whether a specific statute applies.

10. Communications and text messages

If you provide your phone number and agree, Derek may call or text you about your inquiry. Message and data rates may apply, and message frequency varies. You can opt out of texts at any time by replying STOP, and get help by replying HELP. See our SMS Terms for full detail. Providing a phone number is optional and is not a condition of any purchase.

11. Children's privacy

This site is intended for adults and is not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe a child has provided us information, contact us and we will delete it.

12. Third-party links

The site may link to third-party websites and services we do not control. Their privacy practices are their own; please review their policies. We are not responsible for the content or practices of sites we link to.

13. Changes to this policy

We may update this policy as the site or the law changes. When we do, we will revise the "Last updated" date above, and material changes will be made prominent. Your continued use of the site after an update means you accept the revised policy.
